2.The content of the pages on this Website is provided to Visitors for artistic, cultural, and historical documentation purposes relating to the pictorial production that accompanied and contributed to the rise of cinema as the seventh art during the twentieth century. The content is also made available for informational and evaluative purposes and may be modified at any time without notice.Neither SacWebphoto nor third parties provide any guarantee or warranty regarding the accuracy, timeliness, performance, completeness, or suitability of the information or materials found on this Website for any specific purpose or form of use not expressly defined in these Terms of Use and/or on the Website.The Visitor acknowledges that any use of the information provided on this Website is entirely at their own risk. It is the Visitor’s responsibility to ensure that all products, services, or information available through this Website meet their specific needs, and SacWebphoto shall bear no liability except where expressly stated and promised by SacWebphoto.

3.Through these Terms of Use, SacWebphoto informs Visitors that over the years it has collected and developed a digital archive containing more than 30,000 images (digitally recovered), including posters, “bustafoto” subjects, and film playbills. Whenever possible, SacWebphoto has sought to identify and contact the original authors or their successors in title, in accordance with copyright law governing the economic rights of the represented works (“SacWebphoto Archive”).This extensive research required significant investment and meticulous effort. However, if despite such diligence any legitimate rights holders have not been identified, they may contact SacWebphoto S.r.l. in writing at Via degli Olmetti, 40 – 00060 Formello (RM), providing proof of ownership, to agree in good faith on usage terms or to request the removal of the image from the Website.

4.The images in the SacWebphoto Archive, organized for the purposes described in Section 2, are displayed on the Website (specifically within the Website’s Catalog, the “SacWebphoto Catalog”) in reduced format and resolution, and are watermarked to protect the intellectual property rights of their respective owners.

5.Subject to the additional terms and conditions provided in other sections of the Website, SacWebphoto offers for sale high-resolution prints of the images included in the SacWebphoto Catalog. These images are digitally restored to return them, as closely as possible, to their original condition and to remove overlaps, inconsistencies, or discolorations caused by imperfections in the original prints.The prints are sold at the clearly stated prices on the Website, based on the chosen format, material, and/or finish.Prints are produced using SacWebphoto’s own digitally restored and high-definition files.

6. For large-format prints, special materials, enhanced finishing, or otherwise customized products of appropriate quality, additional professional digital restoration may be required. This may involve different preparation times and costs depending on the condition of the image available.For this reason, no predetermined price can be offered, and such purchases can only proceed after specific written agreements with SacWebphoto.

7. Visitors wishing to purchase prints on this Website (allowed exclusively for private decorative purposes) must:Carefully read the Privacy Policy (available at https://www.sacwebphoto.it/privacy).Provide consent for the processing of personal data—including name, surname, shipping address, email address, and phone number—as described therein.Review, understand, and if desired, print and approve the General Terms of Sale (available at https://www.sacwebphoto.it/contratto-di-vendita).

The Website does not allow the creation of user accounts or private areas. Any data provided will be processed solely for order management, delivery, and communications related to the purchase, in full compliance with EU Regulation 2016/679 (GDPR).

During checkout, the Visitor may be offered the option to voluntarily subscribe to the SacWebphoto Newsletter by selecting a dedicated consent box.

This choice is optional and does not affect the ability to complete the order.

8. The Website contains material owned by SacWebphoto, licensed to SacWebphoto, or otherwise lawfully available to SacWebphoto. This material includes but is not limited to images, designs, layouts, appearance, and graphics.Reproduction is prohibited except in accordance with applicable copyright laws and sector regulations, which form an integral part of these Terms.Unauthorized use of this Website may give rise to claims for damages.Use of this Website and any disputes arising from such use are governed by Italian law.

9. SacWebphoto shall bear no liability for any unauthorized use of the images displayed on the Website and/or of the prints, and any individual engaging in such use shall indemnify SacWebphoto against all consequences arising from potential violations of third-party rights.

10. Through the Website, the Visitor may access external resources or third-party websites.The Visitor acknowledges and agrees that SacWebphoto has no control over such resources or websites and is therefore not responsible for their content or availability.
